Welcome to the CookPop mobile app ("CookPop"), provided by Limitless Being LLC ("We", "Us", "Company"). These Terms of Service, together with our Privacy Policy and any other documents they expressly incorporate, set forth the terms and conditions upon which you may access and use the CookPop app and the services provided by Limitless Being LLC ("Service"), including any content and functionality offered through the Service ("Terms of Service" or "Agreement").

PLEASE READ THE TERMS OF SERVICE CAREFULLY BEFORE YOU START TO USE THE SERVICE. BY USING THE SERVICE, YOU REPRESENT THAT YOU ARE AT LEAST 13 YEARS OF AGE. FURTHER, YOU ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE TERMS OF SERVICE. IF YOU ARE NOT 13 YEARS OLD OR DO NOT WANT TO AGREE TO THESE TERMS OF SERVICE, YOU MUST NOT ACCESS OR USE THE SERVICE.

We reserve the right to change, add or remove portions of these Terms of Service and any documents incorporated herein at any time and at our sole discretion. Your continued use of the Service following the posting of revised Terms of Service means that you accept and agree to the changes.

1. Use of the Service

General

Subject to the terms and conditions of this Agreement, and during the term of this Agreement, Limitless Being LLC grants you a non-exclusive and non-transferable right to access and use the Service in accordance with the terms of this Agreement, and any documentation made available to you by Limitless Being LLC, solely for your personal, non-commercial use.

The Service is enabled by technology, software, and certain content delivered electronically. You agree that you will not reverse-engineer, decompile, disassemble, translate, or otherwise attempt to obtain access to the source code of, any aspect of the Services, including any and all technology, software and content. You will not copy, reproduce, alter, create derivative works from, or otherwise modify the Services. You will not lease, loan, sublicense, distribute, or otherwise provide others access to any aspect of the Services.

Description of Service

The CookPop Service is an AI-powered recipe generation mobile app. It is designed to help home cooks discover personalized recipes by transforming user-provided ingredients (via text or photo input) or cooking questions into complete recipe suggestions. The Service provides recipes with instructions, ingredient lists, estimated nutritional information, and AI-generated food photography. Features include conversational AI for recipe discovery ("Ask Cook Pop"), an ingredient pairing tool, and the ability to save favorite recipes.

The Service does not provide professional medical, nutritional, or food safety advice. The recipes, nutritional information, cooking instructions, and all other content provided are for informational and inspirational purposes only. You are solely responsible for your own health and safety. You should always consult with a qualified professional, such as a doctor or registered dietitian, for any health concerns or specific dietary needs.

2. Registration

You may be required to register for the Service and provide certain information about yourself. All information we collect about you in connection with the Services is subject to our Privacy Policy. By using the Service, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

You will receive a user account for your personal use, which may be created through services like Apple Sign In. You are responsible for all activities that occur under your user account. You shall:

  • Have sole responsibility for the accuracy, quality, integrity, legality, and reliability of all data you provide.
  • Maintain the confidentiality of your account information.
  • Use commercially reasonable efforts to prevent unauthorized access to, or use of, the Service, and notify the Company promptly of any such unauthorized use.
  • Comply with all applicable local, state, and federal laws in using the Service.

3. Term and Termination

The term of this Agreement will begin upon your successful registration for the Service and will continue indefinitely unless terminated by either party as permitted herein.

The Company may suspend or terminate your access to the Service at its sole discretion, without notice, if you:

  • Breach any term of this Agreement.
  • Engage in any conduct that the Company determines may have an adverse effect on the Company, the Service, or its reputation.

4. Disclaimer for AI-Generated Content, Recipes, and Nutrition

The recipes, cooking instructions, nutritional information, food photography, and all other guidance provided through the CookPop Service are generated by artificial intelligence (AI) and are intended for general informational purposes only.

By using the Service, you acknowledge and agree that:

  • Accuracy is Not Guaranteed: AI-generated content may contain errors, inaccuracies, or omissions. We make no guarantees regarding the accuracy, reliability, or completeness of any information provided.
  • Food Safety and Allergies: You are solely responsible for ensuring that the ingredients you use are fresh, safe for consumption, and free of any allergens that may affect you or others consuming the food. The Service cannot identify allergens in your ingredients or recipes. Always double-check ingredients and follow safe food handling practices.
  • Nutritional Information is an Estimate: Nutritional data (e.g., calories, protein, fat, carbohydrates) is generated by AI and provided as an estimate for informational purposes only. It is not a substitute for professional advice from a registered dietitian or doctor and should not be used for medical purposes, such as managing a health condition.
  • Recipe Outcomes May Vary: Cooking is a variable process. We do not guarantee the outcome or quality of any recipe. Factors like ingredient quality, cooking equipment, and personal skill will affect the final result.
  • AI Images are for Illustration: The food images are AI-generated for illustrative purposes and may not accurately represent the final appearance of a prepared dish.

If you have any food allergies, dietary restrictions, or health concerns, you must consult with a qualified professional before preparing any food based on information from the Service.

5. Intellectual Property Ownership

Except for the limited license and use rights expressly granted to you under these Terms of Service, all title to and the rights in the Service, including any and all technology, software, and content (including AI-generated text and images), and including ownership rights to patents, copyrights, trademarks, and trade secrets, is the exclusive property of the Company and/or its third-party licensors.

6. Non-Confidential Information

Subject to any applicable terms and conditions set forth in our Privacy Policy, any communication or material that you send to us or transmit through the Service, such as photos of ingredients, questions, comments, or suggestions, is and will be deemed to be non-confidential. We will have no obligation of any kind with respect to such information and will be free to use any ideas, concepts, know-how, or techniques contained in such communication for any purpose whatsoever, including but not limited to, developing and marketing products and improving the Service.

7. Service Access and Changes

We reserve the right to withdraw or amend this Service, and any material we provide in connection with the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. We may also update the content on this Service, including recipe generation algorithms, AI features, and other content, from time to time. However, we cannot guarantee that the content is always complete or up-to-date.

8. Trademarks

Trademarks, service marks, graphics, and logos used in connection with the Service are the trademarks of their respective owners. You are granted no right or license with respect to any of the trademarks mentioned above. You acknowledge and agree that all text, graphics, photographs, trademarks, logos, visual interfaces, artwork, computer code, and all other related content contained on the Service is owned by the Company or third parties and is protected by intellectual property laws.

9. Third-Party Links and Technology

The Service integrates and relies on third-party technology and services ("Third-Party Technology") to provide its core functionality, such as artificial intelligence-based recipe and image generation. Any and all Third-Party Technology is provided solely for the functioning of the Service and is not under our direct control. The Company does not endorse, recommend, or make any representations or warranties with respect to any Third-Party Technology. Your use of the Service constitutes your agreement to abide by the terms of these third-party providers where applicable.

10. Intended for Users Over 13

The Service is not intended for use by individuals under the age of 13. We do not knowingly collect personal information from or provide Services to anyone under the age of 13.

11. Indemnity

You agree to defend, indemnify, and hold harmless the Company, its officers, directors, partners, employees, contractors, agents, licensors, and suppliers from and against any claims, actions, or demands, liabilities, and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Service or your violation of these Terms of Service.

12. DISCLAIMER OF WARRANTIES

THE COOKPOP SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NEITHER THE COMPANY NOR ITS AFFILIATES WARRANT THAT USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. THE COMPANY AND ITS AFFILIATES SPECIFICALLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE COMPANY OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

13. Limitation of Liability

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. THIS INCLUDES, BUT IS NOT LIMITED TO, RELIANCE BY YOU ON ANY INFORMATION OBTAINED FROM THE SERVICE, OR THAT RESULTS FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO THE COMPANY'S RECORDS, PROGRAMS, OR SERVICES.

IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS OF SERVICE, THE COMPANY IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE, THE COMPANY'S LIABILITY WILL IN NO EVENT EXCEED THE AMOUNT OF FEES PAID BY YOU, IF ANY, DURING THE PRECEDING 12-MONTH PERIOD FOR THE SERVICE.

14. Governing Law

You agree that all matters relating to your access to or use of the Service, including all disputes, will be governed by the laws of the United States and the laws of the State of Delaware without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Delaware, and waive any objection to such jurisdiction or venue.

15. Waiver of Trial by Jury

EXCEPT WHERE PROHIBITED BY LAW, YOU EXPRESSLY WAIVE TRIAL BY JURY IN ANY JUDICIAL PROCEEDING INVOLVING ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OR THE SERVICE.

16. General Provisions

  • No Waiver: The failure of the Company to insist on or enforce strict performance of these Terms of Service will not be construed as a waiver by the Company of any provision or any right it has to enforce these Terms of Service.
  • Severability: The provisions of these Terms of Service are severable. The invalidity, in whole or in part, of any provision of these Terms of Service will not affect the validity or enforceability of any other of its provisions.
  • Entire Agreement: These Terms of Service and our Privacy Policy constitute the sole and entire agreement between you and Limitless Being LLC regarding the Service and supersede all prior understandings, agreements, representations, and warranties, both written and oral.
